This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
Welcome to QuickCopy (the "Platform" or "Services"). These Terms of Service (this "Agreement") legally bind you and govern your access to and use of the QuickCopy web application, APIs, and associated infrastructure. By accessing, registering, or using our Services, you unconditionally agree to be bound by these Terms.
1. Eligibility and Account Registration
Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. By registering, you warrant that you are eligible to enter into a valid contract. You agree to: (a) provide true, accurate, and complete information; and (b) promptly update your credentials. Registration is subject to secure authentication via Single Sign-On (SSO) or verified OTP mechanisms. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Acceptable Use and Security Policies
Prohibited Conduct & Account Suspension
Any unauthorized use, reverse engineering, or attempts to circumvent our security features, including the Unified Payments Interface (UPI) integration or our device fingerprinting algorithms, is strictly prohibited. Engaging in such acts may result in immediate suspension of services and potential legal action under Section 43 and Section 66 of the Information Technology Act, 2000.
You agree not to upload any Customer Content that is unlawful, defamatory, obscene, or violates the intellectual property rights of any third party. QuickCopy reserves the right to terminate accounts involved in malicious queue hoarding or storage abuse.
3. Customer Content and Intellectual Property
You retain full ownership and intellectual property rights to the documents, text, and files ("Customer Content") you upload. By uploading, you grant QuickCopy a limited, non-exclusive, royalty-free license solely to parse, process, and execute the physical printing of such materials. QuickCopy disclaims any liability arising from the infringement of intellectual property rights due to the content uploaded by users.
4. Payments, Pricing, and Refund Policy
All prices are dynamically calculated based on the configurations (e.g., page count, color) set by the respective campus shop. Payments are facilitated through verified third-party UPI payment aggregators governed by the Reserve Bank of India (RBI) guidelines.
Cancellation & Refunds: Print orders are processed in real-time. Once a transaction is successfully authorized, the order is immediately dispatched to the print queue. Consequently, all payments are non-refundable, and cancellations are not permitted post-authorization.
5. Disclaimer of Warranties
THE PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QUICKCOPY EXPLICITLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUICKCOPY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
7. Indemnification
You agree to defend, indemnify, and hold harmless QuickCopy and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Platform; (b) your violation of any term of these Terms of Service; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your Customer Content caused damage to a third party.
8. Force Majeure
QuickCopy shall not be liable for any failure or delay in the performance of its obligations under this Agreement if such failure or delay is caused by acts of God, war, strikes, cyber-attacks, power outages, natural disasters, or other events beyond our reasonable control.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to this Agreement, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Kerala, India. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.
